Can I build a dual occupancy on R2 zoning in NSW?

R2 Low Density Residential is the most common zone in Sydney. Here's exactly what you can and can't build under the NSW Housing Code.

R2 Low Density Residential is the zone covering most of suburban Sydney. It's designed for detached family homes — but that doesn't mean dual occupancy is off the table. Here's the definitive guide.

What is a dual occupancy?

A dual occupancy means two dwellings on one lot — either attached (side-by-side duplex) or detached (two separate houses on one title). In NSW, dual occupancy is now code-assessable in most R2 zones thanks to the State Environmental Planning Policy (Housing) 2021.

The key rules for R2 dual occupancy

  • Minimum lot size: 500 m² for an attached dual occupancy, 600 m² for a detached dual occupancy.
  • Minimum lot width: 12 m for attached, 18 m for detached (as measured at the front building line).
  • Height limit: Two storeys (max 8.5 m to the ridge).
  • Setbacks: Front 4.5 m, rear 3 m ground floor / 6 m first floor, sides 0.9 m.
  • Landscaping: At least 20% of the lot must remain as landscaped area.
  • Parking: 1 space per dwelling minimum.

Can I do it as Complying Development?

Yes — if your lot meets the above dimensions, a dual occupancy in R2 can be approved as Complying Development (CDC) by a private certifier. No DA needed. Typical approval time: 10–20 business days vs 6–18 months for a DA.

What councils have banned dual occupancy in R2?

Some councils applied for and received approval to exclude dual occupancy from the Housing Code in their LGA. The most notable exclusions as of 2024 are Ku-ring-gai, Mosman, and Lane Cove. Always check your specific LEP — Zonely surfaces this per address.

Is subdivision possible?

Yes, after building a detached dual occupancy, you can apply to strata or Torrens-title subdivide, creating two separate lots. Minimum lot size for each resulting lot varies by LGA (typically 300–350 m²).

The bottom line

R2 is more flexible than most buyers assume. A 600 m² R2 lot in Sydney's inner west could support two detached dwellings, each worth $1.2M+, at a build cost of $600K total — making the land purchase economics very different from a simple house-and-hold strategy.
